From time to time First National Bank of America (the “Bank”) may be required by law to provide to you certain written notices, disclosures, authorizations, acknowledgements or other documents.   Described below are the terms and conditions for providing to you such notices, disclosures, acknowledgements or other documents electronically through the Adobe electronic signing system (“Documents”).    Please read the information below carefully and thoroughly, and if you can access this information electronically to your satisfaction and agree to these terms and conditions, please confirm your agreement by clicking the “I Agree” button.

Before We can engage in a transaction electronically, it is important that You understand Your rights and responsibilities.  Please read this “Disclosure and Consent to the Use of Electronic Signatures and Records” (“Disclosure”) carefully, as it contains important information. In this Disclosure, “We”, “Us” and “Our” means First National Bank of America. “You” and “Your” means the person giving this consent. “Communications” means each disclosure, notice, agreement, statement, record, document or other information we provide to You, You sign or submit to Us, or related to Your banking relationship with the Bank.  “Transaction” means the establishment/opening or ongoing maintenance of an account you have with us.

Consent

Your consent to communicate with Us electronically will apply to all transactions You perform with the Bank.  If a Document is unavailable to You in electronic form, a paper copy will be provided to You free of charge.  Conducting this transaction electronically is an option.  If you chose not to accept receipt of e-disclosure, paper copies will be mailed to You.   Unless You consent, You have the right to receive all required disclosures or notices in paper or non-electronic form.

Even after you consent to receive communications electronically, if  You want to receive a paper copy of this Disclosure or notice (in addition to the electronic disclosure or notice), or any other communication We provide to You electronically, You can obtain a paper copy free of charge by writing Us at the address below, or sending Us an email.

By consenting to conduct this transaction and receive communications electronically, You agree to provide Us with the information (such as your current email address) needed to communicate with You electronically and update Us as to any changes in such information by calling or writing Us at the number or address listed below.

Withdrawal of Consent

You can withdraw Your consent at any time by calling or writing Us at the number or address listed below.  To withdraw your consent you must state your e-mail, full name, mailing address and telephone

Hardware and Software Requirements

To receive disclosures, notices and other electronic communications You must have:

  • A valid, active email address:
  • Access to a “current version” of an Internet browser that supports 128 bit encryption Adobe Acrobat® Reader 7.0 or higher. “Current Version” means a version of the software that is currently being supported by its publisher;
  • A computer and operating system capable of supporting the above that also has sufficient electronic storage capacity on your computer’s hard drive or other data storage unit;
  • Internet Access

If the hardware or software requirement change in the future, We will notify You  of the change.  If You choose to withdraw Your consent upon notification of the change, You will be able to do so without penalty.  Paper documents would be mailed to You if You withdraw consent.

We reserve the right to provide any communications in writing, rather than electronically. Except as otherwise provided in this or other agreements, by law, or on our website, You cannot give Us notices electronically, and all notices from You must be in writing.
